These terms apply to all users of the domain guild.store and their sub-domains (henceforth: the site). The Terms and Conditions will be valid for all your future transactions with GUILD (GUILD ATELIER OÜ) (henceforth: GUILD; may be referred to as ’us’) and visits to the site. GUILD reserves the right to revise these terms and conditions. Users are responsible for keeping themselves updated with such changes.

 

Disclaimer

GUILD does not guarantee that all items included in the web shop are in stock at the time of your order. In the event of a backorder, we will contact you shortly by phone or by e-mail. We cannot promise that the content of the site is free of inaccuracies or typographical errors at all times. Neither can we guarantee that all information is up-to-date. GUILD may, at any time, amend the content of the site. Although GUILD strives to display the correct texts, images and pricing on the site and web shop, errors may occur. If you have been charged the wrong amount in the web shop, we will give you the option of placing a new order with the correct price or canceling your order. GUILD, however, reserves the right to cancel any order prior to dispatch should we find that the price is incorrect. In such case we will notify you by email. If we are unable to contact you, your order will be automatically cancelled. Part of the services mediated through the site are maintained by outside organizations. In situations where GUILD acts as agent for such services, we cannot be held responsible for any errors resulting from their activities. GUILD cannot be held responsible for any damages caused by using the site or, for that matter, not being able to use the site. GUILD cannot guarantee problem-free, uninterrupted, and secure access to the site.

Please note that items in your cart are not reserved, they may be purchased by other customers until you have purchased the order at checkout and received a order confirmation.

 

Order Confirmation

As soon as your order is placed, an order confirmation is sent to the email address you registered in the checkout. The order confirmation contains your order number, details of the item that you ordered, payment and delivery details. Please note that the confirmation e-mail is only an acknowledgement that we have received your order, is not an acceptance of the order.

 

Shipping Confirmation

Once your order has been dispatched from our warehouse, a shipping confirmation will be sent with all relevant information about your order.

 

Payments

For all the orders GUILD accepts payments by credit card (VISA, MasterCard, American Express), by PayPal, by Cryptocurrencies, and by Estonian, Latvian, Lithuanian, and Finnish bank links. Payments take place in a secure environment outside the webstore – when paying with a bank link in the secure environment of the respective bank, when paying by credit card in the secure environment of Stripe, when paying by cryptocurrencies in the secure environment of Coinbase and when paying by Paypal, then in the secure environment of Paypal, respectively.

GUILD transfers the personal data necessary for the execution of payments to the authorized processor. If you pay by credit card the order amount will be held on your card once your order has been placed. Your card will be charged as soon as your order is confirmed. You will then receive a confirmation containing a receipt of the purchase. We do our best to make our Website as secure as possible to shop at. Your card payment is securely handled using the latest security technology available. All information is encrypted using SSL encryption, which prevents unauthorized access to card details.

 

Shipping

Guild offers different delivery methods that are listed in the checkout. We aim to ship all orders within 48 hours on business days. Please note that shipping times may be affected during peak periods (e.g. sales, holidays, and new releases) and the processing of your order may then take longer than usual. Also please note made-to-order and pre-order items may take longer than regular items, as the production time is different, all these comments will be available at the made-to-order or pre-order item.

 

Returns & Exchanges

You are entitled to return your order free of charge within 14 days after receiving the delivery (return must be shipped by day 14). The package may be opened upon receipt but all items returned must be unused (in the same condition received). All original packaging must also be returned unused. Items returned after 14 days of receiving the delivery will be sent back to the customer. Please note we do not refund shipping fees.

The period of the withdrawal shall be calculated from the day the Client or a third party named by him or her, who is not the carrier of the goods, has received the possession of the product. If the order consists of more than one shipment, the deadline for withdrawal is calculated from the date of arrival of the last parcel to the Client. The Client has no right to return the product, which is made by special order. EXAMPLE: If a customer adds a comment, that would like to have 5cm longer sleeves (then this product is made by special order and is not refundable) Also made-to-measure (made by his or her measurements) and pre-order items are not refundable, as the product is custom made.

If you wish to exchange to a different style, size, or colour, please return your unwanted item and place a new order for the desired item. We will refund your returned item once we have received it at our warehouse. Or contact us via email and we will try to find the best solution for you. Please note we do not refund shipping fees.

Please retain a copy of your return receipt from the postal office in case anything should happen during the return process.
Sale: Our policy above do not apply during the sales period and on sale items.

 

Receiving A Faulty Item

If you receive a faulty item, please notify us immediately. We are responsible for the nonconformity to requirements and defects of the products for 2 years from the receipt of the products by the client. Thereat, within the first six months after delivery to the client, it is presumed that the deficiency was present upon delivery. The online store is responsible for refuting this presumption. Please note that normal wear and tear do not constitute a faulty item. On discovering the nonconformity to requirements of the product or defects of the product the Client undertakes to notify GUILD immediately but no later than within 2 months from becoming aware of the nonconformity by sending the respective information to the email address info@guild.ee or in writing to the address of GUILD, Harjumaa, Tallinn, Lai 36, 10133, Estonia

All personal information saved at the site will be handled with the most utmost care. The information that we store will not be sold or used for any purposes other than ensuring the best service possible. It will solely be used for informing you about special offers and other marketing opportunities related to the different divisions of GUILD. Your personal data may be disclosed to third parties only when it is necessary to fulfill the purposes described above. When registering with the site, you have the option not to receive any information from GUILD. If you wish to end your GUILD subscription, you may make the changes in your account settings or send an email to info@guild.store. State your name and email address and a short description of the matter in the email message.

You have the right to review your information on file at any time. This can be accessed by emailing info@guild.store. If the data is incomplete or incorrect, you have the right to have the information corrected. All customers paying by card are subject to validation checks. GUILD reserves the right to delay any order if fraud is suspected. For security reasons, we do not store any payment information in our database.

GUILD uses Secure Socket Layers (SSL), the industry-standard in transferring information to process your orders. GUILD web shop uses the SSL Certificates, which secures communications by encrypting all data to and from the site. For security reasons, we do not store any payment information in our database.

GUILD reserves the right to seek all solutions available at law and in equity for violations of these Terms and Conditions, including the right to block access to the site. Individuals violating the restriction of password-protected areas of the site may be subject to prosecution.

 

Force Majeure

In case of Force Majeure, GUILD obligations will be suspended. The contract between you and GUILD can, in such cases, be partially or fully terminated by yourself or by GUILD. A Force Majeure is in the event of war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events. Under such circumstances, GUILD will attempt to resolve all issues in a timely manner.

 

Governing Law

These terms of use are complied in accordance with Estonian law and the Estonian courts will have exclusive jurisdiction for any dispute under this agreement. The laws of your country may differ from Estonia and there may be additional legal requirements to use this website. You must comply with all applicable local and international laws and regulations regarding your use of our website.

 

Duties & Taxes

Your order may be subject to import duties and taxes, which are levied once a shipment reaches your country. GUILD cannot control and is not responsible for any duties/taxes applied to your package upon delivery. You will be responsible for paying additional charges for customs clearance. Customs policies vary widely from country to country; please contact your local customs office for further information. Note, on rare occasions custom agents may delay delivery of some packages.
